§1. Acceptance and accounts

FeedFusion is operated by Joana Parente, em nome individual, based in Faro, Portugal. Contact: hello@feed-fusion.com. Full registered details (NIF, registered address) are provided on invoices and on request.

By creating an account or using the Service, you accept these Terms in full. If you do not agree, do not use the Service.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must be at least 18 years old to create an account. If you create an account on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

§2. Subscription, plans, and billing

FeedFusion offers three plans: Free, Pro, and Agency. Current pricing and feature limits for each plan are listed on the Pricing page. Paid plans are billed on a subscription basis and renew automatically at the end of each billing period. You will be notified of any price changes before the renewal date.

All prices are in EUR. VAT or other applicable taxes are added where required by law.

Payments are processed by Stripe. By subscribing to a paid plan, you agree to Stripe's Terms of Service. FeedFusion does not store payment card details.

Auto-renewal notice: Your paid subscription renews automatically at the end of each billing period. To prevent renewal, cancel before the renewal date. See §3 for cancellation instructions.

If a payment fails, FeedFusion will make reasonable attempts to notify you by email. Access to paid features will be paused 7 days after a failed payment. You may resolve the payment issue at any time to restore access.

§3. Cancellation and refunds

You may cancel your subscription at any time from your account dashboard or by emailing hello@feed-fusion.com. When you cancel, your access to paid features continues until the end of the current billing period. We do not issue prorated refunds for unused time within a billing period.

Save as provided below, if you are a consumer resident in the EU, you have the right to withdraw from your first paid subscription within 14 calendar days of its conclusion, without giving any reason, in accordance with Decree-Law 24/2014 of 14 February 2014. To exercise this right, you must notify FeedFusion by email to hello@feed-fusion.com before the end of the withdrawal period. FeedFusion will reimburse all payments received within 14 days of notification.

The 14-day withdrawal right does not apply to renewals of an existing subscription. On upgrades from one paid tier to another, the 14-day right applies to the incremental amount of the upgrade only.

Your rights under Decree-Law 84/2021 of 12 October 2021 in respect of non-conforming digital services are not affected by this clause.

§4. Acceptable use

FeedFusion is for legitimate purposes. You're responsible for all content you display through the Service and for following applicable law.

You agree not to use FeedFusion to:

• Distribute illegal content, malware, phishing material, or spam
• Harass, threaten, or incite violence against any person or group
• Display child sexual abuse material or any personal data of children under 13
• Host hate speech, terrorist content, or non-consensual intimate imagery
• Display electoral content or paid political advertising
• Make medical or health claims
• Infringe the intellectual property rights of any third party
• Reverse-engineer, scrape, or circumvent rate limits on the Service
• Share or resell API keys or account access with third parties
• Use FeedFusion API output to train AI or machine learning models ("model extraction")
• Operate high-risk AI applications as defined under the EU AI Act
• Resell or sub-license the Service without express written permission

We may suspend or terminate access immediately and without notice for violations of these rules.

§5. Service availability

FeedFusion is provided "as is" and "as available." We make commercially reasonable efforts to keep the Service available and to notify you in advance of planned maintenance windows.

FeedFusion relies on the Instagram Graph API operated by Meta Platforms, Inc. FeedFusion is not responsible for outages, policy changes, or breaking changes introduced by Meta. Changes to the Instagram API may affect the Service, and we cannot guarantee uninterrupted access to Instagram data.

No service level agreement (SLA) applies to the Free plan.

§6. Your content and data

You retain ownership of your Instagram content, account credentials, and any data you submit to the Service. By using FeedFusion, you grant Joana Parente a limited, non-exclusive licence to access, cache, and serve your Instagram feed data for the sole purpose of providing the Service to you.

FeedFusion does not sell, share, or use your content for marketing or any purpose beyond operating the Service.

Backup, data retention, and deletion are handled in accordance with the Privacy Policy.

§7. Intellectual property

FeedFusion (its software, brand assets, and documentation) is owned by Joana Parente. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service as described. You may not reproduce, modify, distribute, or create derivative works from any part of FeedFusion without written permission.

§8. Disclaimers and limitation of liability

Save for damages resulting from willful misconduct (dolo) or gross negligence (culpa grave) of FeedFusion, or for damages to life, physical or moral integrity, or health (Article 18(a) and (c) of Decree-Law 446/85), FeedFusion's total liability to you, in contract or tort, is limited to the amount paid by you in the 12 months preceding the event giving rise to liability. FeedFusion is not liable for lost profits, lost data, lost opportunity, or indirect or consequential damages. Mandatory consumer rights under Portuguese and EU law are not affected by this clause.

§9. Indemnification

You agree to defend, indemnify, and hold harmless Joana Parente from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) content you display through the Service; or (c) your violation of these Terms.

This indemnification does not apply to the extent that a claim arises from FeedFusion's own gross negligence or willful misconduct.

§10. Termination

Either party may terminate the agreement at any time. You may terminate by cancelling your subscription and deleting your account. FeedFusion may terminate your access immediately for a material breach of these Terms.

On termination, you may export your data within 30 days. After that period, your data will be deleted in accordance with the Privacy Policy.

§11. Changes to these Terms

FeedFusion may update these Terms from time to time. Material changes will be communicated by email and via a banner in the dashboard at least 30 days before the effective date. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

§12. Governing law, jurisdiction, and dispute resolution

These Terms are governed by Portuguese law, excluding its conflict-of-laws rules. For disputes not involving consumers, the courts of Faro, Portugal have exclusive jurisdiction.

If you are a consumer resident in the EU, you retain the mandatory consumer protections of your country of habitual residence under Article 6 of Regulation (EC) 593/2008 (Rome I), and you may bring proceedings in the courts of your country under Article 18 of Regulation (EU) 1215/2012 (Brussels I bis).

Alternative dispute resolution: Consumers may refer disputes to CNIACC (Centro Nacional de Informação e Arbitragem de Conflitos de Consumo), at www.cniacc.pt. FeedFusion is not bound to any alternative dispute resolution entity.
